Background - What is WHS legislation?

Safe Work Australia created the WHS laws in 2011 to be used across Australia. States and territories have to implement the model WHS laws separately in order for them to be legally binding. Safe Work Australia is responsible to maintain the WHS model laws. However, they do not regulate or enforce them.

The model WHS Act is the foundation of WHS Acts which have been implemented across Australia.

The Act's main purpose is to create a national consistent and balanced framework for protecting the safety and health of workers and their workplaces. 

This is done by:

  1. - Protecting workers and others from harm by requiring duty-holders to reduce or eliminate risk
  2. - Providing fair and effective representation, consultation, and cooperation
  3. - Encouraging unions and employers to play a constructive part in improving WHS practices
  4. - Promoting the provision of information, advice, education, and training in WHS
  5. - Effective and appropriate enforcement and compliance measures are necessary to ensure compliance with the Act
  6. - Ensuring proper scrutiny and review of all actions taken by people with powers or functions under this Act
  7. - Assisting in continuous improvement
  8. - Maintaining and strengthening WHS legislation harmonization in national countries and encouraging a national consistent approach to WHS.

This course will include an understanding of awareness of the relevant legislation and your responsibilities in applying knowledge of WHS legislation in the workplace .

Learning outcomes include:

  1. Apply knowledge of the relationship between WHS Acts, regulations and codes of practice to assist in identifying WHS legislative requirements in the workplace
  2. Contribute to monitoring compliance with legislation 
  3. Contribute to ensuring that workplace complies with legislation 
  4. Identify and take appropriate action on non-compliance with legislation 
  5. Recognize limits of own expertise and legal duties, and access help and advice when required
  6. Use relevant sources to keep up-to-date with legislation and relevant publications
  7.  Communicate information on relevant legislative changes and relevant publications to others
